The User assures and guarantees to Data-Crédito that it will not share or reveal to other persons or employees of The Affiliate, the security password that has been assigned to it to access the Data-Crédito system, in accordance with the Contract signed between the Affiliate and Data-Crédito.
Confidentiality Policy Applicable to Affiliates
The information requested from Data-Crédito and obtained by The User will be for the exclusive use of The Affiliate, and The User may not make any consultations for other persons or companies other than those which appear as signing this Contract, even though they are persons or companies affiliated with or owned by The Affiliate; these persons or companies, as may be the case, must sign their own Contracts with Data-Crédito.
Anti-Marketing Profiling Policy
Data-Crédito, as a high-technology company that handles confidential information, is committed not to reveal or market the information received from its Affiliates for purposes of "Market Profiling," in benefit of another Affiliate, nor any other person or institution.
Law 288-05, which regulates credit information businesses, Title IV, Chapter II, Article 44:
"The BICs are forbidden to do the following:
44.1.- Grant or transfer totally or partially the information supplied by a Data Provider, to be used by another Data Provider, User, Subscriber, or Affiliate, or a third party in unfair competition practices; The BICs may not create, prepare, or sell or transfer lists of select debtors or consumers to their subscribers or affiliates, or to any other person or company, so long as said lists of prospects has not been previously drafted and delivered to the BICs by the Subscribers or Affiliates themselves, for purposes of making consultations in batches."
